FirstChants products are designed to help upcoming producers and artists easily collaborate with other talented artists and instantly generate revenue.

Our Products

FirstChants products are developed by Calvin Magondo, a limited company based in London, England, and operated by our team based in London. Our website firstchants.com, as well as our subdomains, are run by our internal team. We use third-party services to build our products, keep in touch with customers, and help us understand how we can improve our products through analytics data. Many of those services collect data about you, our customers, but we aim to be as explicit and transparent as possible when this is the case. Below we outline precisely what those services are, how we use them, and how we store & utilize any data those services provide. If you contact FirstChants by email, we may keep a record of your correspondence or comments. We may ask for your name, e-mail address, and contact information in order to send you a reply.

Data Used by Our Website

We have custom built our website, but run our servers & all domains on Wix.com. Regarding your data, we may use a service called Mixpanel Analytics to allow us to anonymously track general user behavior (such as the percentage of visitors who click a button) in order to improve the website and understand how effective it is in conveying what our company does & how it provides value. For any advertising campaigns we run through Google Forms, Mailchimp and/or Wix, we also anonymously track users who interact with that advertising campaign through to downloading our products and whether they end up paying for it or not.

Website Terms & Conditions

By downloading any of our products you agree to—and are bound by—the terms and conditions set out in this document. Our products should only be installed on a device with an operating system approved by your phone’s & computer’s manufacturer. You should also ensure that if you are not the owner of the device you intend to use these products on, you have obtained permission from the owner. If you use our products, we shall assume you have obtained appropriate permission.

Data Used by Our Products

All of the information entered in our products, such as your email or written data, is visible within our products only when a user is logged in with the email address used on sign up and a secure password. That information cannot be seen by anybody other than the account owner. As you use our products, we collect analytics data using Mixpanel, including:

1. Information about your device and city location

2. Information about specific steps taken in our products (e.g., how often a customer writes a journal entry)

3. Information about general user behavior of the entire user population

We use this data regularly to determine how to improve our product. We also use Bubble and/or Mailchimp from time to time to contact customers via the email address they used upon sign up, with product updates or free resources. We take privacy very seriously & work hard to balance your privacy with our desire to continuously improve our products.

Appendix A – Optional PayPal Payout Workflow Terms

Applicability: This section applies only if you (the artist) choose to

1. Provide your PayPal payout details in your Artist Profile, and

2. Tick the “I agree to PayPal Workflow Terms” checkbox when prompted.

If you do not opt in, you remain subject to our standard Stripe Connect terms and payout schedule, and Platform will not withhold or forward any funds to PayPal.

A.1 Merchant of Record; No Fiduciary Duty

A.1.1 By opting in, you acknowledge that FirstChants (“Platform”) is the merchant of record for all payments (including tips) processed via Stripe on your behalf. Platform does not act as a fiduciary or trustee and is under no obligation to segregate funds beyond ordinary business practices.
A.1.2 You further acknowledge that funds will first be collected into Platform’s Stripe account, then forwarded to your designated PayPal account as described below.

A.2 Disbursement Schedule; Artist Responsibility

A.2.1 Your net balance of tips and other fan payments will be held in Platform’s Stripe balance.
A.2.2 Platform will remit that balance to your PayPal account weekly, every Friday UTC.
A.2.3 You are solely responsible for providing and maintaining accurate PayPal payout information (e.g., PayPal.Me link or Business email) in your Artist Profile. Platform is not liable for delays or losses due to incorrect or outdated PayPal details.

A.3 Fees, Refunds & Chargebacks

A.3.1 Platform’s Stripe processing fees, any Platform service fees, and PayPal payout fees will be deducted from gross receipts before your disbursement.
A.3.2 If a fan requests a refund or a chargeback is assessed, Platform may deduct the refunded amount (plus any associated fees) from your next scheduled payout. You remain responsible for all chargebacks and agree to cooperate in any dispute resolution.

A.4 Compliance & Indemnity

A.4.1 You understand that by using this manual forward-to-PayPal workflow, Platform may in certain jurisdictions be deemed a “money transmitter.” Platform holds no money-transmitter licenses and does not provide banking or fiduciary services.
A.4.2 You are solely responsible for obtaining all licenses, registrations, or regulatory approvals required to receive or remit payments in your jurisdiction.
A.4.3 You agree to indemnify, defend, and hold Platform harmless from any claims, fines, penalties, or expenses arising out of your use of this workflow.

A.5 Opt-In Confirmation

By checking “I agree to PayPal Workflow Terms” you confirm that you have read, understood, and accept all of the above. You may revoke this opt-in at any time by removing your PayPal details from your Artist Profile, after which you will revert to standard Stripe Connect payouts.

Your Use of the FirstChants Products

You agree that our products are for domestic and private use only and you will not use our products for any commercial, business, or resale purposes. You also agree that when using our products you will comply with all applicable laws and these terms. In particular, you will not use our products in any way contrary to any applicable law or for any purpose which is not its intended purpose. You must not:

• Make copies of our products, alter, modify, disassemble, reverse-engineer, or create any derivative works;

• Infringe any rights in relation to copyright and/or trademarks;

• Collect or harvest any information from any service or our systems or attempt to decipher any transmissions to or from our products.

Liability

Our products are provided on an “as is” basis for domestic and private use. Your use of our products is at your own risk. To the maximum extent permitted by law, we:

• Disclaim all liability whatsoever, whether arising in contract, tort (including negligence), or otherwise; and

• Exclude all implied warranties, terms, and conditions relating to our products.

In particular, we accept no responsibility for:

1. Any technical failure of the internet and/or our products resulting in you being unable to use our products;

2. Any damage or injury to you or your equipment as a result of your use of our products;

3. Your information becoming lost, stolen, intercepted, or corrupted.

We do not accept liability for any loss or damage caused by using this app whether foreseen or otherwise, including but not limited to:

• Losses incurred before use of this app;

• Business losses;

• Loss resulting from your failure to adhere to these terms; and

• Losses caused by a third party.

Your statutory rights are not affected.

“Sensitive” Information

FirstChants does not seek to collect “sensitive” Personal Information about you (race, ethnicity, beliefs, health data, etc.). We will not request it. If you voluntarily post such information, you assume the risk of it being accessed by others.

Persons under 16 should not transfer Personal Information without parental consent. We do not knowingly collect information from anyone under 13. If you are under 13, please do not access our Service; we will delete any such data if discovered.

Your Rights to Your Personal Information

You have rights including:

• To be informed of how we use your data;

• To access or correct it;

• To object to processing for marketing;

• To request deletion or portability in certain circumstances;

• To lodge a complaint with the UK Information Commissioner’s Office (https://ico.org.uk/) or your local authority.

How to Exercise Your Rights

Contact us at calvin@firstchants.com. We may need ID to verify your request. We aim to respond within one month; complex requests may take longer.

Changes to Your Personal Information & Unsubscribing

Keep your Personal Information accurate by updating your account. You may unsubscribe at any time; upon doing so, we will delete your data except for limited backup copies or records we are required to retain for legal purposes.

Promotional Offer: £25 Artist Incentive (Limited Offer)

FirstChants may offer promotional incentives. Current offer: the first 10 qualifying artists who sign up at firstchants.adalo.com, connect their Stripe account, and create a public post within 48 hours will receive a one-time £25 reward via Stripe within 5 working days. Offer limited to new users, one entry per person, may be withdrawn at any time.

Acceptance of These Terms

By using FirstChants—and if you opt in, by ticking “I agree to PayPal Workflow Terms”—you confirm that you have read, understood, and agree to these Terms & Conditions (including Appendix A if applicable). Platform reserves the right to modify or suspend any workflow, fees, or schedules at any time upon 14 days’ notice.
